Booking terms

Acceptance and confirmation

Submitting a booking request and paying the £200 booking fee does not by itself confirm the performance booking. BigWig Productions will check the request and normally contact the client within 48 hours of verifying payment. If more time is needed, including during holidays, we will contact the client to agree an extension. There is no automatic acceptance through silence or lapse of time.

The performance booking is accepted when Dave Wiggins expressly confirms it by telephone, in person or in writing. Telephone or in-person confirmation will be followed by an email record. No handwritten or electronic signature is required for this agreed booking process. Before acceptance, the client may withdraw the request and receive a full refund. If BigWig Productions declines the request, all sums paid for it will be refunded promptly. This does not limit any statutory rights or any rights arising from an already accepted booking.

Payment and booking fee

The £200 booking fee forms part of the total fee and is deducted from the balance. Booking fees are refundable within 14 days of payment. After that period the booking fee is non-refundable following client cancellation of a confirmed booking, subject to applicable law and the cancellation provisions below. The remaining balance is payable in cash on the event date or by bank transfer at least two days before the event. Cheques are not accepted.

Client cancellation after confirmation

Notify BigWig Productions promptly in writing. The maximum cancellation charge is the booking fee more than 30 days before the performance; 25% of the total fee 22-30 days before; 50% 15-21 days before; 75% 8-14 days before; and 100% within 7 days. Any booking fee or other payment already received is credited, not added twice. Charges will not exceed reasonable net losses caused by cancellation, allowing for costs saved and replacement bookings. The promised booking-fee refund within 14 days of payment and statutory rights remain unaffected.

Changes or cancellation by BigWig Productions

We will contact the client promptly if we cannot fulfil a confirmed booking. An alternative act or date may be offered, but requires the client’s agreement. If we cancel without an agreed replacement, sums paid for the cancelled performance will be returned. A refund does not exclude any other remedies the client may have under applicable law. Changes to the package, price, location or schedule must be agreed in writing.

Performance and production

The agreed fee covers the selected show, stated travel and production requirements. Disco is included only where explicitly selected, for the finish time stated in the booking details. There is no automatic free disco or overnight-stay exemption. Additional services or extended hours require agreement and a price before they are supplied. The stated live-show allowance is approximately two hours including the interval.

The artistes will be suitably dressed and provide equipment in good working order, with appropriate electrical safety checks. Sound levels will be set reasonably with the client and venue, subject to applicable restrictions. Artistes are responsible for their own tax and National Insurance.

Venue arrangements and safety

The client must arrange safe access, an adequate performance area and a safe suitable mains power supply. Outdoor performances need appropriate weatherproof cover and suitable power agreed in advance. Tell us about sound limiters and venue restrictions before confirmation, so a safe compatible arrangement can be agreed. We will not perform where doing so would be unsafe; we will discuss reasonable alternatives and any resulting charges, subject to applicable law.

A secure, suitable changing room and place for the artistes’ belongings must be provided. A toilet or store cupboard is not sufficient. The client should share the agreed production requirements with the venue and supply a venue contact. The client is responsible for damage they cause through negligence or deliberate acts, to the extent legally recoverable; this is not automatic liability for every guest’s behaviour.

Meals for the band

The client must provide a hot meal for each band member. If meals are not provided, a fee of £20 per musician is payable in addition to the quoted performance fee. This provision applies to four-, six-, eight- and eleven-piece bands.

Unavoidable disruption and legal rights

If circumstances outside either party’s reasonable control prevent performance, both parties will discuss alternatives and handle cancellation, payments and refunds in accordance with applicable law. Nothing in these terms excludes liability that cannot legally be excluded or removes the client’s statutory rights. A company booking is with the identified legal entity; no personal director guarantee is created by this document.
